Consent and Purpose Limitation

This is particularly challenging with complex deep learning models, but techniques like SHAP values and attention visualization can help provide meaningful explanations.
The Privacy Commissioner has signaled increasing attention to algorithmic transparency, particularly in sectors like financial services and healthcare where automated decisions directly impact individuals.
Data Minimization
Generative AI models often benefit from large training datasets, but PIPEDA's limiting collection principle requires organizations to collect only the personal information necessary for identified purposes. This creates a tension that technology leaders must navigate carefully.
Best practices include using anonymization and de-identification techniques before feeding data into AI systems, implementing differential privacy where appropriate, and documenting the justification for the scope of data used in AI training.
Provincial Considerations
Canadian businesses must also consider provincial privacy legislation that may impose additional requirements.
Quebec's Law 25 (formerly Bill 64) introduces specific obligations around automated decision-making, including the right of individuals to be informed when decisions are made exclusively by automated processing. Organizations operating in Quebec must implement mechanisms for individuals to have automated decisions reviewed by a human.
Ontario's PHIPA adds healthcare-specific requirements that intersect with AI deployment in clinical settings. AI systems processing personal health information must meet stringent security and access control requirements.
Practical Compliance Framework
We recommend a five-step framework for managing PIPEDA compliance in AI deployments.
First, conduct a Privacy Impact Assessment for each AI initiative. Document the personal information involved, the processing activities, the purposes, and the risks.
Second, implement privacy-by-design principles in AI development. Build data minimization, purpose limitation, and access controls into the AI pipeline from the start.
Third, establish an AI governance committee with representation from legal, privacy, technology, and business stakeholders. This committee should review and approve AI use cases before deployment.
Fourth, develop clear documentation of AI training data provenance, model behavior, and decision-making logic. This documentation will be essential for responding to access requests and complaints.
Fifth, implement ongoing monitoring and auditing processes for deployed AI systems to detect drift, bias, and unauthorized data use.

The proposed Artificial Intelligence and Data Act (AIDA) will introduce additional AI-specific regulations when enacted. While the final form of AIDA remains under development, organizations that establish strong AI governance practices now will be well-positioned to meet future requirements.
